1. Area of application
The following terms and conditions apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.
Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
The fact that delivery is made exclusively to business addresses does not alter the fact that contracts are concluded with consumers within the meaning of Section 13 of the German Civil Code (BGB), provided that the order is made predominantly for private purposes.
2. Contracting parties, conclusion of contract, correction options
The purchase agreement is concluded with HerkulesGroup Services GmbH.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. By clicking on the order button, you are placing a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted.
3. Prices and payment method
The price stated in the order is binding.
Unless expressly agreed otherwise in writing, statutory value added tax is included in the final price.
Unless expressly agreed otherwise, the price includes packaging and transport costs.
When the contract with us is concluded, the following applies depending on the payment method you have chosen:
Credit card / Google Pay / Apple Pay
When you place your order, you provide your credit card details and the credit card company performs an authorization check. Once you have been verified as the legitimate cardholder, the payment transaction will be initiated automatically and your credit card will be charged when you place your order.
PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing your order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.
Klarna
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you various payment options. Payment is made in accordance with the Klarna terms and conditions displayed during the ordering process.
4. Delivery terms
Unless expressly agreed otherwise, all deliveries shall be made to the delivery address specified by the seller.
Delivery is made exclusively to business locations of the HerkulesGroup or its affiliated companies in Germany and Austria. Delivery to private residential addresses is not possible.
Please note that individual products cannot be delivered to all countries for logistical or legal reasons.
5. Warranty and guarantees
Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
The following applies to used goods: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The above restrictions and shortened periods do not apply to claims based on damage caused by us, our legal representatives, or vicarious agents:
• in the event of injury to life, limb, or health
• in the event of intentional or grossly negligent breach of duty and malice
• in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, if agreed, or
• insofar as the scope of application of the Product Liability Act applies.

6. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can access [https://ec .europa.eu/consumers/odr /] here. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
